The MSA is a professional association set up to promote the art and science of anaesthesiology. We are a national body that co-ordinates the activities of anaesthesiologists practising in Malaysia. As a representative body for anaesthesiologists, we aim to promote professionalism, cooperation and friendship amongst anaesthesiologists, and are in liaison with similar bodies and specialties in other regions and in the international arena at large.
The meeting was convened to discuss the recent memorandum that was released regarding the choice of anaesthesia for daycare surgical procedures. The memorandum suggested that local anaesthesia (LA) should be prioritised as the first-line anaesthetic modality for procedures and surgeries unless clinically contraindicated
The discussion was held in a cordial mutually respectful manner with open and constructive engagement from all parties. Representatives from the MSA, CoA, and MMA reiterated that any directive or memorandum issued by the healthcare industry or third- party administrators (TPAs) cannot supersede clinical decision-making which must always remain the prerogative of qualified medical practitioners. The Malaysian Society of Anaesthesiologists (MSA) and the College of Anaesthesiologists (CoA), Academy of Medicine of Malaysia expresses their serious concerns regarding a recent circular issued by a third party administrator (TPA). This circular appears to recommend that surgeons should prioritise local anaesthesia over general anaesthesia for surgical procedures. This profit-driven dictation by an insurance company represents an intrusion into medical decision-making and constitute an unethical attempt to dictate patient care. We, representing the following organisations, (1) Malaysian Society of Anaesthesiologists, (2) College of Anaesthesiologists, Academy of Medicine of Malaysia and (3) Malaysian Society of Intensive Care, would like to issue this statement following the decisions made by the High Court, the Court of Appeal and subsequently the Federal Court in March of 2024. We fully respect the decisions made by the learned judges and the processes that were undertaken before such a verdict was passed. We understand the need to have an impartial system that can address the rights of patients seeking legal recourse.
Nevertheless, we do need to express some concerns with regards to the rising trend of medicolegal cases in the country.
